The more prepared you are, the more apparent your future will be and the more empowered you will feel.

Get Prepared / WORKING OUT THE LAW / Picking the lawyer that is right for you.

Picking the lawyer that is right for you.

  1. What is your lawyer's experience?
  2. How many divorce cases have they handled?   Don't be afraid to ask for references.
  3. What steps are involved in the divorce process?
  4. How long will the process take?
  5. Do they have the time to give your case the attention it deserves?
  6. Are phone calls to your divorce lawyer encouraged, what are the best times, and how promptly are calls returned.
  7. Do they prefer scheduled appointments to discuss your case?
  8. How much will it cost?
  9. Is there a retainer?
  10. What things are charged for at an hourly rate?
  11. Is a monthly bill sent out?
  12. How much are the filing fees?
  13. Will your divorce lawyer or a legal assistant be handling your case?
  14. If a legal assistant is involved, what is the hourly rate for their service?
  15. What is their view on settlement versus litigation? (You don’t want to battle in court if it’s not necessary)
  16. Ask for a written retainer agreement.
  17. This is the contract that states what the divorce lawyer agrees to do for your, and how much you will be billed and how often.

You will probably need to interview a few lawyers before you find one that you are comfortable with.  Don’t be afraid to ask questions.  Divorce lawyers are there to help you make many important decisions and should be willing to discuss any of your concerns.  If they have specific suggestions for your case, ask them how it can affect you in the future.  While this is new territory to you, divorce lawyers are used to navigating all the issues.  Remember that you are paying for their knowledge.
